Postal Packets Regulations create a "clear border" | Steven Barrett


It is not possible, as law, to say that the Postal Packets (Miscellaneous Amendments) Regulations 2023 are of no great importance. Or to claim they are consistent with the removal of a the border in the Irish Sea.


The regulations create a very clear border, which is undeniable as law.


Movements of goods, internally within our country that today take place freely in parcels will become ‘illicit movements’. The Windsor Framework is the Protocol Parliament rejected many years ago. It creates a GB/NI border – with powers of seizure to goods movements in violation of it.


I have not, in my experience, ever seen such a momentous constitutional change done in effective secrecy via a King Henry VIII power.
